    In present society there is a major problem that has been seen with the most controversial word that is Maintenance.this word is to be followed from ancient times but in different manner and now it’s fixed and to be very much specified about this term regarding human beings. Whether it is come for the case of divorce or any kind of seperation not only from wife it is also from children or aged parents. In our Constitution, has given the separate power to them for claiming their rights and take action if that Rights are violating by any means. In Hindu Dharma Shastra the Manu who is the first law maker said that “it is a man’s duty to maintain his wife, children, aged parents even he has to pertake in a hundred misdeeds “. The Rights of a parent’s is very much important in our society because still some where in every cases has been seen that either after getting all property from parents the legal heirs or so called be loved son’s are not giving a minimum value to their parents and they sent them to a street or a new shelter or the children are by coercion or forcefully or by cheating to their parents for getting the property. The Code of Criminal Procedure 1973 has taken an most important role regarding these kinds of noise. In chapter IX of the Code mentioned all criteria regarding the parental laws for maintenance if such stated issues farther has not been arise in a critical form. There are also mentioned in various laws that gives a perfect and strong support related to this Rights such as, Preamble of India,  Fundamental Rights, Directive Principles of State Policy, Hindu Adoption and Maintenance Act,1956, Hindu Marriage Act, 1955, Guardian and Wards Act, Hindu Minority and Guardianship Act etc. So through this Acts, it helps to sort out all problem and it is a  biggest supporter or piller for those person whe really needs .
